The Future of Competition Law and Policy in the ASEAN Countries: Issues and Challenges

Co-organised by the Sorbonne Assas International Law School, Concurrences Journal and ESSEC Business School, the conference on “The Future of Competition Law and Policy in the ASEAN Countries” will be held on Thursday, 23 April 2015.

Event outline

This conference was conceived taking into consideration two timely elements: 1) The ASEAN Regional Guidelines on Competition Policy recommend the introduction in all ASEAN countries of nation-wide competition policy and law by 2015, and; 2) The International Competition Network (ICN) annual meeting will take place in Sidney from April 28 to May 1st, 2015. This conference delves into the issues raised by the implementation and enforcement of antitrust rules in the ASEAN countries and offers the opportunity to discuss the hottest topics with some of the most prominent local and international antitrust academics, enforcers, and practitioners

The Welcome Address will be delivered by Prof. Martine Bronner, Dean of ESSEC Asia-Pacific, and Prof. Daniel Cohen, Dean of Sorbonne Assas International Law School.

The Keynote Speech will be delivered by Aubeck Kam Tse Tsuen, President of the Singapore Competition Commission.

Partnership agreement with the Paris Bar, France

Sorbonne-Assas International Law School-Asia signed an partnership agreement with the Paris Bar, France (L’Ordre des Avocats de Paris).

The agreement was signed during the meeting in the “Maison du Barreau” held in Paris on 11th February 2015 in the presence Mr. Jean-Louis Scaringella, Director, EFB Paris Bar School, Mr. Laurent Martinet, Vice-President of the Paris Bar Association, and Professor Guillaume LEYTE, President of Pantheon-Assas University, Professor Stephane Braconnier, Dean of Sorbonne – Assas International Law School-Asia.

The objective of the partnership is, in particular, to organise international executive programme for European Lawyers in Asia (Singapore).

Executive Program 2015 – Legal Environment for doing Business in China

EXECUTIVE EDUCATION OPEN PROGRAM

  • Over the past forty years, Chinese laws and legal institutions have developed quickly while in the meantime China was living deep economic, political and social reforms.
  • This course will first explore the impact of the recent and current economic and political context on the legal framework for doing business in China.
  • Then the course will develop an overview of the PRC legal system.
  • In a third part, the lecture will expose the range of legal vehicles available for foreign investors wishing to enter the Chinese market. In this part, a specific emphasis will be made on the practices recommended to optimize the protection of overseas investors’ interests in China, depending on the legal structure, and on specific issues relating to the management of foreign direct entities (shareholders’ control, investment strategy, financing, shareholders’ and managers’ liability).
  • Based on concrete examples, this course will be of interest to students looking to better understand the legal framework of setting up legal entities in China. The objective will be to give the audience a practical view of which entity can be set up in China and within which limits/ framework/ and constraints.
  • The course will also cover the general framework of the labor PRC law and social protection of workers in China. A specific focus on the rights and duties of employees/employers will be made.
  • The lecture will end by giving an overview of the Intellectual Property protection by the Chinese system.

SPEAKER’S PROFILE

Nathalie Boué: business lawyer with more than 15 years of expertise in French, Chinese and Japanese laws.

She holds Master’s Degree from University Paris II in Corporate and Tax Law (1993), Industrial Property Law (1994) and a “Magistere” of Business and Tax Law (1993).

After graduating from ESSEC business school in 1996 and being admitted to the “Paris Bar” in 1997 as “Avocat a la Cour”, Nathalie practiced law in France during 10 years in the French law firm Casanova & Associés (Paris), where she used to advise French and European companies on distribution French law matters and business law matters. She gained also an intensive experience as a litigator on economic criminal law matters in front of the French courts.

Since 2007, Nathalie Boué is based in Asia.
There she advised foreign companies on Chinese law and Chinese practices, gaining extensive experience on a wide range of legal issues, including competition law, distribution, IP and labor law.

Ms. Boué helped foreign companies set up legal entities and negotiated and drafted many kinds of commercial and corporate cross-border transactions. As a member of the Board of the French Chamber of Commerce and Industry in China (CCIFC) from 2008 to 2010, she was actively involved in the local business community in Shanghai.

She has advised French and Japanese companies on all range of legal matters and notably on international mobility issues, cross-border transactions and doing legal business in Asia.

Nathalie Boué has frequently lectured in China, France, Spain and Japan on the legal environment in China over the last six years.

Thought her lectures, Nathalie Boué always focuses on giving concrete insights on the Chinese practices and the approach of the Chinese market by overseas investors.
